User Agreement

1. Acceptance of Terms
1.1. By using the Speakylex application, you agree to these Terms. If you do not accept the terms, delete the application immediately.
1.2. Before using the Speakylex application, the User must review these Terms and consent to personal data processing. Privacy Policy.

2. General Provisions:
2.1. The application enables the following actions:
a) Learn languages through AI chat:
- Communicate with a virtual assistant in the target language;
b) Work with learning materials:
- Use pre-made phrase/topic sets from the community
- Create and share custom sets
- Add and study words through a personal tagged dictionary.
c) Practice skills:
- Complete vocabulary/grammar tests;
- Listen to word pronunciations in the audio player;
- Study grammar rules;
d) Systematic learning:
- Complete structured courses;
- Analyze progress in statistics;
2.2. The User agrees to properly comply with this Agreement;
2.3. The User agrees not to use the Application in violation of the Company's rights and legitimate interests under this Agreement and Russian law;
2.4. Prohibited:
- Unauthorized infrastructure interference: DDoS attacks, hacking attempts, vulnerability exploitation;
- Use of bots, scripts, scraping, or other automated data collection without the Administration's consent;
- Resale or transfer of account access to third parties for commercial purposes;

3. Age Restrictions
3.1. The Service is exclusively available to persons aged 16 and older;
3.2. By registering, you confirm you are 16 years of age or older;
3.3. You guarantee the accuracy of provided age information;
3.4. Any access attempts by users under 16 will result in account and data blocking without compensation;
3.5. If there are reasonable suspicions that a User is under 16, the Service Administration may request additional verification via email (e.g., parent/guardian confirmation) or temporarily restrict account access;
Failure to provide confirmation within 7 days will result in permanent account blocking;

4. Social Functions
4.1. Prohibited:
- Publishing 18+ content;
- Sharing contact details (phones, addresses);
- Adding strangers under 16;
- Spreading false information about courses;
- Spam/fraud;
- Harassment in communities;
- Copyright/trademark infringement, sharing personal information without consent;
- Distributing unverified information (fakes) that may harm users or public order;
- Promoting violence, hate speech, or discrimination based on race, religion, etc.;

5. Account Deletion and Suspension
5.0. The User may delete their account and personal data at any time by sending a request to contact@speakylex.ru with the subject line "Account Deletion". After account deletion, data is processed in accordance with the Privacy Policy (depersonalization/destruction timeframes).
5.1. We reserve the right to suspend or delete accounts for material or repeated violations of this Agreement;
5.2. We reserve the right to suspend or delete accounts for subscription purchases with stolen cards;
5.3. We reserve the right to suspend or delete accounts for payment system circumvention;
5.4. Users may appeal account suspension within 14 calendar days of blocking by submitting a reasoned request to support at contact@speakylex.ru. We will review appeals within 30 calendar days of receipt;

6. Intellectual Property
6.1. All lessons, algorithms, and design are our property;
6.2. Prohibited:
- Copying content for commercial purposes;
- Decompiling code;
- Creating derivative works (including clones, forks) based on the Application for distribution, commercial use, or competition with Speakylex;
6.3. Users retain rights to their created learning materials while granting Speakylex a perpetual, royalty-free license to use, reproduce, modify, and publicly display within the Service;

7. Application Functionality:
7.1. We take reasonable measures to ensure service availability;
7.2. We do not guarantee data transfer speed or form submission/file upload speed;

8. Artificial Intelligence
8.1 AI-generated translations/exercises/dialogs:
- Are not professional advice;
- May contain inaccuracies;
- Do not guarantee academic results;
8.2 The AI chat and related features are intended solely for language learning (e.g. practice dialogues, translations, exercises). Use of the AI for other purposes (e.g. bulk content generation, automated requests, extraction of data, or any use not related to learning within the Service) is prohibited. We reserve the right to suspend or block accounts in case of attempts to use the AI for unintended purposes.

9. Refunds
9.1. Refund rules and procedures follow the policy of the app store you use: Ru Store, Google Play, App Store, Telegram Mini Apps. Timing and methods depend on the platform. As of the publication of these Terms, subscription and service payments are available only through the above app stores;
9.2. If Speakylex introduces direct payment for subscriptions or services through its official website in the future, refunds will be governed by the terms published on the website and Russian Federation legislation (Consumer Rights Protection Law);

10. Subscription Cancellation
10.1. Cancellation policies and procedures follow the rules of your app store platform: Ru Store, Google Play, App Store, Telegram Mini Apps. Timing and methods depend on the platform;

11. Amendment of Terms
11.0. The Administration may amend this Agreement. Users will be notified of material changes by email (to the address provided at registration) and/or via in-app or website notice. The new version takes effect upon publication unless otherwise stated in the notice. Continued use of the Service after the amendments take effect constitutes acceptance of the new Agreement. If you do not agree to the changes, you must stop using the Service and delete your account.

12. Liability Limitation
12.1. The Service is provided "as is". We are not liable for any indirect, incidental, special damages, or lost profits arising from Service use;
12.2. Our aggregate liability for any Service-related claim is limited to the amount paid for the Service during the 6 months preceding the claim;

13. Final Provisions
13.1. This Agreement is governed by Russian Federation law;
